从立法、法理两个角度对人像摄影作品著作权和人身权的冲突问题进行分析,指出冲突的根本原因在于权利的相互性,冲突的解决应遵循人格权高于著作权的一般原理,完善权利的配置机制,并提出解决之最有效途径便是使肖像权和著作权的权利主体归于同一,即通过立法规定肖像摄影作品的著作权属于肖像权人。

this papert analyzes the conflicts between the copyright of portraiture photography and the right of person in terms of legal principle and legislation, and points out that the underlying cause of the conflicts lies in the mutuality of the two rights. To solve the issue, the paper argues that one of the most effective way is to unify the subjects of the two rights in accordance with the general principle of the right of person superior to the copyright .
