摘要
国家精神损害赔偿长期以来一直是学术界争议的一个话题。随着市场经济的发展和人们法制观念的加强,国家赔偿法所存在的问题日渐暴露出来。国家赔偿制度的完善和发展,可以看作是民主法治进程的标尺。本文从国家赔偿制度在实践中存在的问题开始讨论,从法律上提出了国家精神损害赔偿的具体范围,论证了国家精神损害赔偿的必要性和局限性。
State mental compensation for damages has been a debate for a long time in academic circles. With the development of market economy and the strengthening of people＇s legal knowledge, the problems in law of state compensation for damages have gradually exposed. The perfection and development of the system of state compensation for damages are regarded as the surveyor＇s rod of democratic legality course. The paper begins with discussing the problems in implementing the system of state compensation for damages, puts forward the specific scope of state mental compensation for damages from the angle of law, and expounds the necessity and limitation of state mental compensation for damages.
