Transplantation of Laws in the Anthropological Perspective ——The Formation of SHENG YU TAN, A Non-governmental Religious Organization in Weishan Mountain

立法是法律移植动态过程中的一个环节。只有经过长期的调适,实现与文化系统其他方面的有机整合之后,移植之法才能成为民众“共有的习惯性行为模式”。我们不应仅仅将法律当做是实现社会变革的工具,还应考虑与历史的衔接,同时,必须保持“文化自觉”,以确保人类文化的多样性及发展的可持续性。

Legislation is an important hinge in the dynamic transplantation of laws. Only when integration with the rest of the cultural system is realized through long-time adaptation, can the laws transplanted become “common habitual norms of behavior” of the populace. Not only should laws be regarded as a tool to achieve social transformation, consideration should also be given to their continuity with the past and the necessity to maintain “cultural consciousness” so as to ensure the diversity of human cultures and the sustainahility of human development.
