摘要
监督过失是处于监督管理地位的人违反监督、管理义务,对其应当防止的危害结果因疏忽大意或者因过于自信没有防止的心理态度。监督过失在主观上须预见到被监督者的过失行为,客观上须违反监督管理义务,正确认定监督过失,对惩治、预防职务犯罪有重要意义。
Supervisory negligence means that the person in supervision and management position violates the official duty and does not prevent the dangerous outcome that he should because of negligence or assertiveness. The tenability of supervisory negligence should prove that the supervisor has foreseen the fault behavior of the person under supervision subjectively and violates the official duty objectively. The correct cognizance of supervisory negligence is important for punishing and preventing official offence.
