论我国商业秘密的法律保护

On the Legal Protection of Business Secret

商业秘密是知识产权的一种表现形式,受到法律保护。我国保护商业秘密的现有立法尚存在缺陷。通过对我国商业秘密法律保护现状问题的分析,建议我国的商业秘密法律保护应在反不正当竞争法中对商业秘密的法律界定、政府部门的保密义务、竞业禁止、侵权的举证责任以及商业秘密的价值评估等方面进行立法改进,而不需要专门的商业秘密立法。

Business secret is of intellectual property protected by law. There are deficiencies in the present legislation in this respect. This article is an analysis on the issue of legal protection of business secret. It is suggested that China should improve business secret protection in the legislation against unfair competition by legally defining business secret, specifying government obligations, prohibitions on competing businesses, proof-evidence duty of infringement and, value evaluation of the business secret, while it is unnecessary to set specific legislation on business secret protection.
