论生育权的法律限制

On Legal Restriction on Child-bearing Right

生育权是人们依法享有生育子女的权利。该权利并非绝对自由的权利,而是受到法律限制的权利。中国背负着巨大的人口压力,有效控制人口的手段是实施人口计划生育的法律制度,而中国人口能否得到控制与管理取决于生育权利的正确行使。生育权滥用是破坏人口生育管理制度的违法行为。本文从生育权滥用的理性分析入手,寻找生育权受限制的理论依据,指出禁止生育权滥用的有效对策。以期达到改变人们生育观念,有效控制人口增长的目的。

Child-bearing right is the right that people have to bear child according to law. The right is not an absolute freedom, but a restrictive right. China is under great pressure of population, so it is an effective measure to enforcement the legal system of birth control and if China＇ s population can be controlled and managed is determined by the correct enforcement of child-bearing right. The abuse of child-bearing right is of illegal action which may destroy population control system. Starting from the rational analysis of the abuse of child-bearing right, the author looks for the theoretical basis for restriction of child-bearing and points out an effective countermeasure.
