试论我国检察机关法律监督范围

On the Legal Limitation of Supervision Power of Chinese Prosecutorial Authority

检察机关履行法律监督职能的范围,既是检察学中的重要范畴,又是人民检察院独立行使检察权的核心问题。欲完善我国检察制度,必须重视对检察监督范围的研究。本文针对检察机关法律监督范围理论与实践的现状,阐明具有中国特色的检察监督范围的确定依据,并提出建立我国检察监督范围的构想和建议。

The problem about the legal limitation of legal supervision power of prosecutorial authority not only is the important conception in the prosecutorial theory, but also is the key issue about the independent prosecution practice of Chinese prosecutorial authority. We should take this issue seriously if we hope to improve the legal system of Chinese prosecution. This article points out both the basis of theory to put the legal limitation over supervision power of Chinese prosecutorial authority and the relevant legal suggestions.
