The Reality of the Conflict of Rights——Discussion with Professor HAO Tie-chuan

权利冲突不是一个伪问题,而是权利内部发生的裂变。虽然权利之间不可能有泾渭分明的界限,不可能有完整的权利位阶划分,但是基本价值仍然存在。通过基本价值判断,再结合具体的法技术,方能化解权利冲突。同时必须区分价值层面的法理学思考与工具层面的法技术运用,这样才能更好地理解权利冲突问题。

The conflicts of rights are not false problem, but internal fission in rights. Although there is neither clear line between rights, nor integrated division of rights rank, fundamental value remains existing. By the judgement of fundamental value, combined with concrete legal skill, the conflicts of rights will be resolved. Meanwhile, we must discriminate the thought of jurisprudence in value from the application of legal skill in specific. Only in this way can we apprehend the conflicts of rights better.
