试论我国宪政文化的缺失及其构建

On the Shortcomings and Construction of Constitutional Culture in China

我国的宪政建设模式是政府推进型的,而不是源于自身市场经济、民主政治、宪政意识发展的自然结果。这导致了中国宪政文化的缺失。我国的传统经济模式——小农经济、传统文化中的民本思想、性善论及义务本位法律观与宪政的核心价值是偏离的。要建设宪政国家,必须发展市场经济,构建宪政文化的经济基础;推动民主政治的发展,构建宪政文化的政治基础;培养公民的宪政意识,构建宪政文化的思想基础。

The construction pattern of the constitution in China is government-promoted, not the natural results from the development of market economy, democratic politics and the constitutional awareness. This, undoubtedly, results in the shortcomings of the constitutional culture in China. The traditional economic pattern in China-the small-peasant economy, the people-oriented thought in the traditional Chinese culture, the theory of original goodness of human nature, the obligation-oriented concept of law, deviates from the core value of the constitution and politics. If we want to build a constitutional government, we should develop the market economy to provide an economic basis for the constitutional culture, promote the development of democratic politics to provide a political basis for the constitutional culture and cultivate the constitutional awareness in our citizens to provide an ideological basis for the constitutional culture.
