消极失范是由于行政主体对行政权的异化行使而侵犯了行政权三要素的完整性,从而动摇了行政权自主性的一种状态。对这种状况进行反思是必要的:一要坚持人性的理性与经验的二重性原理,充分认识非理性因素的影响;二要寻求解决行政权失范的最佳方案,用“疏川导滞”法代替“堙障”法。

Negative deviation is a state in which the main body of administration damaged the integrality of the three administrative elements by exerting its power dissimilatorily and swayed the independence of the administrative power. Self-reflection in this kind of situation is necessary. First, adhere to the dual principle of reason and experience in human nature and fully recognize the effect of irrational factors; Secondly, search for the optimal solution to the problem of negative deviation with a new conception and rational institution.
