试论在公安执法中必要原则的适用——兼议对《道路交通安全法》第53条的理解

A Tentative Discussion on Applying the Principle of Necessity in Police's Law-enforcement—— Comprehension towards Item 53 of "Safety Law of Road Traffic"

《道路交通安全法》第53条赋予公安机关在执行紧急任务时享有特别通行权,公安机关在行使该项权力时,应当符合必要原则,不能超过一定的限度。必要原则在我国行政执法中属于合理性原则的范畴,必要原则要求公安机关在特殊应急情况下执法必须选择适当的方式、方法和强度,在行政诉讼中适用此原则有助于更好地判断公安机关是否滥用自由裁量权。

The Item 53 of ＂Safety Law of Road Traffic＂ entrusts the public security organs the special traffic authorization in an emergency however, they should comply with the principle of necessity so as not to exceed a certain limit. The principle of necessity belongs to reasonable principles in our administrative law-enforcement, which requires the public security organs to select appropriate patterns, methods and strength when taking measures in emergency, so it is helpful to judge whether the public security organs abuse the right of liberal arbitration or not.
