如何在我国农村有效界定、保护和实施产权——关于建立乡镇“巡回法庭”的初步设想

How to Delimit,Protect and Implement Property Rights in the Rural Areas of China—A Preliminary Scheme on Establishing Cruise Courts in the Town and the Countryside

继我国宪法2004年修正案明确了“公民的合法的私有财产不受侵犯”之后,其相关的具体化的法律文件《物权法》也已经呼之欲出。这在我国法制建设史上无疑具有里程碑意义。因为清晰的产权界定是市场交易的前提,是建立社会主义市场经济的基础条件。而广大的农村地区却是我国产权制度建设中最薄弱的环节。因此,建立乡镇“巡回法庭”送《物权法》等民事法律下乡,以便在我国农村有效界定、保护和实施产权,就有可能成为我国深化改革并建设农村法治社会的一个比较现实的选择方案。

The detailed documents of the new laws of Property Rights Statute are to be enacted after the Chinese Constitutional Amendments （2004） confirm that the people＇s legal private property rights can＇t be invaded, which is obviously a milestone in Chinese law history, because the distinct delimitation of property rights is a prelude to market transactions and the base of establishing socialist market economy. But the rural areas are the weak links in the construction of the system of Chinese property rights. Hence, the Property Rights Statute should be implemented in rural areas by establishing the cruise courts in order to delimit, protect and implement the property rights, which may become a practical scheme in deepening reform and constructing a harmonious rural ,society governed by law.
