浅谈不动产交易中第三人保护问题研究

On Some Legal Issues about Third Party Protection in Real Estate Business

不动产交易下的第三人问题较为复杂,本文以不动产交易中第三人利益保护的理性基础为研究基点和线索,从不动产交易中经常出现的不动产无权处分、不动产一物数卖这两大方面来阐述对第三人利益的保护。本文在坚持物权法的“静态秩序、动态安全”的理念,债权法的“合同自由、鼓励交易”理念的前提下,试图对不动产买卖第三人保护这两大问题提出规制措施。

The condition of third part protect is complex. Among the complex conditions of third part protect there are mainly two conditions which are disposal of have no right and one thing two sale. This article insists on the idea that the property law should adhere to static order and dynamic security, and the credit law should adhere to freedom of contract and arouse bar- gain. This article base point on the third part protect in real estate business, set forth protective means to the third part in these two conditions.
