摘要
劳动合同是市场经济条件下劳动关系确立的基础,也是劳动法律制度中的重要内容。劳动法应确认口头劳动合同形式的有效性;应正确处理劳动合同解除与终止的关系,把合同解除作为合同终止的情形之一;改革用人单位支付补偿金的条件,对因劳动者方面的原因导致用人单位解除劳动合同的情形,实行过错责任原则;建立一种以期待利益损失补偿为主,劳动贡献积累、伤病补贴和惩罚性补偿为辅的辞退补偿制度;规定用人单位不愿续订定期劳动合同时,应向劳动者支付不稳定就业补偿金。
Labor contract is the base of labor relationship in the market economy. It is an important part in the labor legal system, too. The oral labor contract should be valid. It is necessary to deal with the relation between revocation and termination correctly, taking revocation as a kind of termination form. It is necessary to reform the payment condition of the compensation,the fault liability principle is implemented when the employer revokes labor contract caused by laborer. It is necessary to establish a compensation system with the main principle that the anticipant benefit loss, the assistant includes the labor contribution,the punishment and the allowance of the disability and disease. The employer should pay for the unstable employment compensation when it does not extend limited labor contract.
