中国《城市规划法》存在的问题及完善

The problems and improvement of China's law of urban planning

城市规划的管理是城市管理中的第一步。在新公共管理的形势下,中国目前的《城市规划法》所规定的管理制度已明显呈现不足,无法适应新形势下的复杂法律关系,必须完善。从行政法的三大研究领域———行政主体、手段及程序分别进行分析,从新公共管理角度对其提出完善的建议。

The management of urban planning is the prerequisite of the city management. On the background of new public management,China＇s recent Law of Urban Planning makes a show of much deficiency in terms of the regulation of management, thus not adapting to the complicated legal relationship any more. So it is in need of improvement. This paper makes an analysis from the main three catagories subject, method （act）, and procedure of management. Also suggestions are mentioned from the aspect of new public management.
