On the Ground of Criminal Individualization——Personal Dangerousness.

作为刑罚个别化根据的人身危险性,仅包括再犯可能,即犯罪人再次犯罪的可能性,而不包括初犯可能。人身危险性的表征因素包括犯罪人的素质特性及犯罪前、中、后的表现。它不影响定罪,仅是量刑个别化及行刑个别化的根据。

Personal dangerousness as the ground of Criminal individualization,includes only the possibility of second offence, but not the possibility of first offence. The indicating factors of the personal dangerousness include the criminal＇s personality and his performance before, in the course of and after the crime. It doesn＇t affect the conviction and it＇s only the ground of sentence and execution individualization.
