我国被害人诉讼权利的完善及制度构想

The Perfection of Victim Lawsuit Right and Its System Conception in China

比较我国与国外被害人在刑事诉讼中的地位及享有的诉讼权利,可以看出我国是非常重视被害人的权益与权利保障的,然而在这方面的立法和制度建设仍然存在缺陷。笔者对我国的被害人权利保护提出一些构想,赋予被害人在刑事诉讼中一些诉讼权利,确立一些有利于被害人的诉讼制度,以求达到与被告人诉讼权利及地位的平衡,以真正实现诉讼的公正。

Compared with the victimg the lawsuit right and status in criminal prosecution between China and the overseas, we may see China pays more attention to safeguarding victimg fights and interests and the right, but there are still many flaws of legislation and the system construction in this aspect. The author proposed some conceptions of our country＇s victim right protection, granted the victim in the criminal prosecution some lawsuit rights, established some lawsuit systems advantageous to the victim, in order to balance lawsuit fight and the status of the accused person, realize lawsuit fair truly.
