摘要
刑事立案监督是检察机关对刑事立案主体应当立案而不立案或者不应当立案而立案侦查，以及刑事立案活动是否合法所进行的法律监督。刑事立案监督对保障侦查主体依法规范行使刑事案件立案权，减少和遏制有案不立、有罪不究、以罚代刑，保护当事人合法权益等具有重要的作用。本文拟对中国现行刑事立法确立的立案监督法律制度及有关问题进行阐述。
The supervision over filing of criminal cases refers to the legal supervision of the procuratorial organs over the non-filing of cases that should be filed or filing for investigation of cases that should not be filed by the criminal case-filing authorities and the legality of criminal case-filing activities. The supervision over filing of criminal cases plays a crucial role in ensuring the investigative authorities to exercise their power to file criminal cases in a legal and standard way, reducing and containing the non-filing of cases that should be filed, non-investigation of crimes that should be investigated and replacement of criminal penalties with mere sanctions, and protecting the legal rights and interests of parties concerned. This article attempts to discuss the legal system of supervision over filing of criminal cases established in the current Chinese criminal legislation and relevant issues.
