摘要 2003年11月3日至2004年7月1日期间,美国人RANDOLPH HOBSON GUTHRIE Ⅲ(中文名顾然地)在其上海住处内,通过国际互联网向境外发送销售DVD信息,然后将其低价购进的侵权复制DVD销给境外客户,共销售侵权DVD13.3万余张,销售金额折合人民币330万余元,违法所得97万余元。美国人CODY ABRAM THRUSH(中文名库迪)、上海市民吴东以及上海彭浦安邦快客雷速递服务部的负责人吴世彪,均在明知顾然地销售侵权DVD的情况下,仍参与其中。 From November 3, 2003, to July 1, 2004, Randolph Hobson Guthrie Ⅲ (an American, a.k.a. Gu Randi in Chinese) had sent DVD sales information abroad on the Internet in his Shanghai residence, and sold infringing duplicated DVDs that he had bought at a low price to customers abroad. In total, he had sold more than 133,000 infringing DVDs, worth more than RMB 3.3 million, with illegal gains of more than RMB 970,000. Cody Abram Thrush (an American, a.k.a. Ku Di in Chinese), Wu Dong, a Shanghai citizen, and Wu Shibiao, a manager of courier service in Shanghai knowing that Gu Randi was selling infringing DVDs had provided assistance in consigning and taking delivery of goods, contacting customers, computer management and delivery respectively. Ku Di and Wu Dong earned illegally RMB 12,000 respectively, and Wu Shibiao RMB 50,000 for such assistance.
