国际商事法律统一化的新发展——《国际商事合同通则》2004修订版述评

The New Development on the Uniform of the International Commercial Law ——On the New Edition of the Principle of International Commercial Contracts

2004年4月国际统一私法协会通过《国际商事合同通则》2004修订版。该版本在1994年老版本的基础上,增加了五部分内容,即代理权限、第三方权利、抵消、权利转让、义务转移和合同转让以及时效期间。通过这次修订,《国际商事合同通则》的内容得到了极大的丰富,其适用无疑将是国际商事法律朝着统一化方向所迈出的一大步。

The new edition of the Principle of International Commercial Contracts was unanimously approved by the Governing Council in April 2004. On the basis of the old edition, the new edition added five componets： Authority of Agents; Third Party Rights; Set-off; Assignment of Rights, Transfer of Obligations and Assignment of Contracts and Limitation periods. The new edition of the Principle of International Commercial Contracts was focus on enlargement rather than revision of the 1994 edition. So, it＇s foreseeable that the new edition of the Principle of International Commercial Contracts would be the new development of the uniform of the international commercial law.
