民族自治地区法律信仰匮缺的原因及对策——以湘西土家族苗族自治州为例

Causes and Countermeasures for Being Short of Legal Belief in National Autonomous Regions

中国是一个正在走向法治的国度,作为现代法治精神内核的法律信仰应当在中国得到普及,但在民族自治地区法律信仰还很匮乏,主要原因是:民族自治地区立法机关“立法权”太小;“村规民约”地位过高;法律移植资金太少;“情→理→法”思维模式的影响。针对上述原因,文章提出了塑造民众法律信仰的对策,即完善立法机制;创良法,优执法,开展对口“法治扶贫”工作。

China is stepping into a law ruled state. Legal belief is key of the spirit of the legality and law should be believed to every Chinese, but there is short of legal belief in national autonomous regions in China. The major causes are the legislative power being too small to legislation body in national autonomous regions and the village regulations having strengthened influence and the funds of legal transplant being small and mode of thinking of feeling-reason-law affecting it. So we should constructed Legal belief by perfecting legislative institute and making good law and creating acceptable enforcement images and taking pre-poor law aid hand in hand.
