论房屋买卖的后合同义务

摘要 合同法对后合同义务只作了原则性的规定,在房屋买卖中出现违反后合同义务的纠纷却屡见不鲜.在司法实践中,正确地、科学地认定违反后合同义务的责任、违反后合同义务的表现形式以及违反后合同义务责任的归责原则和承担方式是十分重要的,主要从以上几个方面加以论述,为全面保护在房屋买卖中买方的利益提供了一条新途径. There is only the basic regulation of post-contract obligations in contract-law, but the disputes of violating postcontract obligations always happen in the estate trade. In legal practices, the following important four items should be clearly recognized. They are the post-eontreat responsibilities, the form of violating post-contract, the principle of recognizing responsibilities ,and the ways of undertaking the responsibilities, which provide a new approach to protect the interests of buyers.
