近年来农村出现的农户承包土地使用权流转,有助于发挥土地资源效益和农民增收。土地使用权流转是一种法律行为,当事人双方应当依法签订书面合同。由于多种原因,目前在土地流转合同方面还存在一些不容忽视的问题。研究解决这些问题,对促进土地使用权流转健康发展,更好地保护合同当事人特别是农民的合法权益具有积极意义。

In recent years the land usage right circulation in the countryside has contributed to improve the production of land resources and increase peasants income. The land usage right circulation is a kind of legal act. Both parties should sign the written contract in accordance with the law. Due to many reasons, there are some serious problems in circulation contract at present. Researching and solving these problems will promote the healthy development of the land usage right circulation and protect the lawful rights and interests of contracting parties especially peasants ＇.
