论宪法上的私有财产权及其实施保障机制

私有财产权是个人权利的基础。许多国家都将私有财产权视为本国宪政的基石,置之于宪法重要位置加以保护。我国于2004年3月14日审议通过的宪法修正案,确立了宪法上的私有财产权保障制度,弥补了原有财产权制度的缺陷。这对我国宪政建设、人权保障、市场经济的深入发展具有重要意义。今后应建立和完善我国宪法实施保障制度,使宪法所确立的私有财产权能变为公民实实在在享有的权利。
