On Habitation

要不要在未来的物权法中规定居住权问题是当前物权法学界的一个热点问题,居住权制度来源于罗马法,广泛应用于大陆法系的民法典,然而从居住权的性质、适用的社会背景以及中国的历史与现实来看,我国并不适宜引进居住权制度。

The necessity of the legislation of the right of habitation in the future real law is a hot issue in the law circle recently. The system of the right of habitation, originating from Roman law, is extensively applied in the civil code of continental law system. However, according to the character of the right of habitation, social background of application and China＇s history and reality,China is not fit for the introduction of this system of right of habitation.
