摘要
国务院2003年6月8日发布,自2003年9月1日起施行的《物业管理条例》,为了规范物业管理活动,就业主与业主大会、前期物业管理、物业管理服务、物业的使用与维护等问题进行了相应的规定。实践中,有关业主委员会的法律地位、物业服务合同的法律性质,以及物业管理制度设计等问题,并未因该条例的出台而中止争议,相反,该条例在物业管理制度设计中存在的缺陷,再次引发人们对物业管理制度设计的思考。
The regulation of estate management formulated by our State Council came into effect on Sept,1,2003. It regulated the following parts: proprietor and proprietor board, previous estate management, service of estate management, the using and maintenance of estate. In practice, some problems about the legal status of proprietor board, legal nature of service contract and the establishment of estate management system didn' t pause after the appearance of this regulation, on the contrary, the backwards in the regulation make us to think of it again.
