摘要
科斯1960年发表的开创性论文“社会成本问题”是现代产权经济学研究的起点,继科斯之后,由三个思想流派构成的后科斯主义产权理论分别从契约主义的观点、民事侵权行为的观点以及权利的观点对产权理论进行了研究,他们的研究对我国《物权法(草案)》的制定具有重要的借鉴意义。
The original and trail-blazing paper “The Problem of Social Cost” published by R · H · Coase in 1960 marks the beginning of modem property right economics. After R · H · Coase, property right theories consisting of three schools of thoughts approach the property right from the perspectives of contract, civil tort and right. Their research results can offer valuable reference for drafting China's Decree of Property Right.
