著作权纠纷案件法理评析——就“奥特曼”系列典型案例的分析 被引量:1

摘要 从2004年年底开始,日本圆谷制作株式会社以中国京、沪、穗三地的4家商业企业和一家制造企业为被告,以被告制作或销售了标有“(”版权标识的奥特曼形象产品,侵犯了原告作为奥特曼影视作品著作权人享有的署名权等权利为由,分别在京、沪、穗三地提起民事诉讼。案件涉及的有关法律问题众说纷纭,莫衷一是。本文结合案情,就下列问题作了分析探究:有关知识产权国际公约在我国的适用,涉外著作权的作者身份和原始版权归属,著作权中的经济权利与精神权利孰轻孰重,《世界版权公约》是否不保护署名权,文字作品与立体作品的署名,销售商的合法来源问题,非著作权人在他人作品版权标记上的署名属于侵权还是不正当竞争等。 From the end of 2004, Tsuburaya Productions (Japan) sued 4 commercial companies and 1 manufacturing plant from Beijing, Shanghai and Guangzhou of China, for the reason that they manufactured and sold the products marked with the figure of Ultraman protected by the “(C)” sign, which is a tort to the right of signature enjoyed by the copyright owner of Ultraman videos. This civil-suit was brought in the three cities mentioned above. The legal issue involved is complicated and has not a single answer. On the basis of this case, this article made some analysis of the issues as follows: the application of international conventions related with intellectual property rights in China, the auctorial status and original copyright ownership of foreign works, the weight of economic rights and spiritual right in copyright, the protection of signature right in Universal Copyright Convention, the signa ture of word works and three-dimensional works, licit source of distributors, and the signature of others on the copyright works, etc.
