摘要
劳动争议持续快速增长对劳动争议处理体制提出严峻挑战,调解作为解决劳动争议的“第一道防线”未能有效发挥作用,导致大量争议案件直接进入仲裁和诉讼程序。应在分析现行劳动争议调解制度弊端的基础上,提出改革设想,重构劳动争议制度。
The sustained rapid increase of labor dispute has been challenging the regulation of labor dispute mediation in China. Mediation, as "the first means" of resolving the dispute, doesn't do its job effectively, thus allowing lots of disputes breaking into the processes of arbitration and action directly. It first analyzes the pitfalls of the regulation of mediation, and then brings forward the assumption of reconstructing the regulation.
