罗尔斯的制度正义理论及其借鉴意义

On Rawls' Theory of the Just-natured System and Its Enlightenment

约翰.罗尔斯在《正义论》和《政治自由主义》两部著作中就正义的内涵、原则等问题进行了系统的论述,指出制度是人们行为的规范体系,认为当这个体系中的规范能使各种利益要求达到恰当的平衡时,制度就是正义的。制度的正义理论既表现为一个规范体系,也表现为一个理论体系。罗尔斯的制度正义理论对于我国进行以社会主义市场经济、社会主义民主政治、社会主义先进文化为取向的制度创新和制度建设具有借鉴意义。

In Theory of Justice and Political Liberalism, John Rawls made a systematic elaboration on thc connotation and principle of justice. He points out system is a system of man＇s behavioral norms and in so far as the norms within it can strike a proper balance among various profit requests, the system is just. The theory of the just- natured system is not only a system of norms but also a system of theories. Rawls＇ theory of the just-natured system offers some insight into the innovation and construction of the system oriented to the socialist market economy, socialist democratic politics and socialist advanced culture.
