我国夫妻约定财产制的完善

On the Completion System of Man and Wife’s Agreed Property in China

夫妻约定财产制丰富了我国婚姻法的内容。但婚姻法对该项内容的规定比较原则,且内容缺失较多,操作起来比较困难。因此,夫妻约定财产制应该按照民法理论,从成立、生效、类型、形式、变更、撤消、终止、夫妻双方的权利和义务、对外效力等方面作进一步完善。

The system of couple＇s agreed property enriched the contents of the Marriage Law ot our country. But, due to the general provision of this system with too many defects, it is difficult to carry out. Therefore, based on the theory of Civil Law, the system should be improved in the aspects of legislation, effect, type, form, alteration, repealing, suspense, rights and duties of both parties of the couple.
