婚姻法对结婚的限制与少数民族习惯法的冲突和法律思考——以贵州苗族为视点

Some law thoughts on restraint of marriage and conflict between marriage law and customary law of ethic minority——seeing from Miao Minority in GuiZhou

2001年婚姻法和少数民族习惯法对婚姻关系的缔结都有着自己的限制。但因为伦理观念、风俗习惯、历史传统不同等因素,二者之间必然存在着一定的冲突。正确认识冲突现象,分析冲突存在的原因,找到解决冲突的方法,是促进婚姻法在少数民族地区施行,确保社会稳定的重要保障。

Both the Marriage Law （2001） and the Customary Law of Ethnic Minority has its own resriction on the establishment of marriage relation . Yet, because of the differences among moral principles , custom and tradition of history, there must be some conflicts between Marriage Law and Customary Law of Ethic Minority . How to realize the conflicts correctly and analyse the original causes and then find a solution to slove them can promote the execution of Marriage Law in Ethic Minority regions , and it also guarantee a steady society.
