刑罚效力是一个属于刑法学意义的概念,长期以来刑法学界集中于刑罚报应和预防本质价值的刑法学论证,逐渐的由对立走向了统一。刑罚效力的犯罪学正效应包括刑罚效力的惩罚性、威吓性和教育改造性;刑罚效力由于刑法的阶段本质、刑罚配置不合理等原因,同样存在着负效应。应从刑法制定的充分民主、刑罚制度合理性以及执法的程序性等方面来避免刑罚效力负效应。

Penalty efficacy is a concept of criminology. For a long time, criminal fields concentrate on the demonstration of penalty retribution and value of precaution essence. They develop from antagonism to uniform gradually. The criminological positive number of penalty efficacy includes the punishment, intimidation, and education and remaking. The negative effects are also existing because of the class essence of criminal law and unreasonable allocation of penalty. The negative effect of penalty efficacy should be avoided from the aspects of full democracy, reasonable penalty system and procedure of law enforcement regulated in criminal law.
