摘要
了解律师在场权制度的概念以及国外立法概况,并在此基础上论述律师在场权制度在刑事诉讼中的价值取向,探讨律师在场权制度的设置、实现和保障机制,对我国的刑事诉讼立法是有益而必要的。
This issue relates to the right of presence of lawyers and a glance at the laws concerned in the other countries. Furthermore, the theme is herewith discussed on its value orientation in the crime litigation. Finally, it proves the necessary of lawyer presence right, including its establishment, realization and guarantee, in order to provide reference to establishment of the laws concerned in the P. R. China.
