摘要
工作场所性骚扰行为在我国已经出现受害者胜诉的案例,2005年6月审议的《妇女权益保护法》首次将其明确纳入法律范围。但除了用民事及行政手段来调整性骚扰行为,是否还有其他更好的方法?在对我国工作场所的性骚扰行为如何在劳动法的范畴内予以调整和防治做一整体说明的基础上,探讨对性骚扰行为进行劳动法调整的可能性、可行性。
There have already been cases where victims of sexual harassment won. The “Law of China on Protecting Women's Rights and Interests” reviewed in June, 2005, includes sexual harassment in workplace into the legal realm. However, besides employing civil and administrative means to control sexual harassment, are there any other better means.9 This paper exactly discusses the possibility and feasibility of adjustment by Labor Law based on the overall explanation to the ways of adjustment and control within the realm of the Labor Law.
