摘要
土地承包经营权不是立法者的立法技术选择的成果,而是国家所有权在法律上的创制,是我国特有的农村经济体制改革的经验在立法上的体现,因而它本身存在许多制度上的缺陷。本文试就土地承包经营的立法背景、所存在的法律问题、法律制度设计进行初步探讨。
Land Contract Management is no more the very result of legislatively technological selection of the legislator than the legal institutionalization of the state property which is not without institutional defect. This paper tries to initiate a preliminary study on the legislative background of the land contract management and its legal problems.
