WTO体制下的保障措施和特殊保障措施

On the Safeguard and Special Safeguard Measures under the WTO Framework

保障措施作为一种贸易救济措施,在国际贸易中对进口国而言有着举足轻重的地位。WTO体制下尽管有保障措施的一般规定,但在不同领域针对不同国家,演变出很多特殊的保障措施。其中,中国《入世议定书》中的“过渡性保障机制”就对中国纺织业产生了重大的影响。

As trade remedy, safegauard measures play an important role in international trade. Although there are general rules on safeguard measures in the WTO framework, special measures are stipulated in different sectors or to different countries. As a compromise for China＇ s entry into the WTO, the Interim Safeguard Measures are inserted in the Acession Protocol which significantly affecte the textile industry. The paper aims to clarify some issues concerning the safeguard measures through analysis of the safeguard and special safegauard measures under the WTO framework.
