摘要
国家赔偿法是一个兼具公、私法属性的法律部门,民法规范是国家赔偿法的法律渊源之一,民事侵权责任在国家赔偿中有其适用的空间。同时,在国家赔偿中适用民事责任用以补救《国家赔偿法》法典的自身不足,也是当前条件下扩大国家赔偿范围的一种可能途径。
The state indemnity law is a branch of law with the characters of both public and private law. The regulation of civil law is a part of the source of state indemnity law and tort liability can be applied in state indemnity too. Further more, applying tort liability to supplement the state indemnity law of China is a probability to widen the scope of state indemnity currently.
