On the Characteristics of the Confucianization of Penal Principle During the Wei,Jin and Northern & Songthern Dynasties

法律儒家化是中华法系最富特色的标志,魏晋南北朝是中国古代法律儒家化的重要时期。文章探究了儒家的礼治原则与魏晋南北朝刑法原则之间的关系,指出魏晋南北朝时期的一系列刑法原则具有的儒家化特征,并对其成因作了分析。

The Confucianization of law is the most characteristic symbol of the system of Chinese Law. It is an important period of Confucianization of Chinese ancient law during the Wei, Jin and Northern ＆ Southern Dynasties. The article finds out the relation of the ritual principle and the penal principle, points out the Confucian characteristics that a whole train of the penal principles possessed during the Wei, Jin and Northern ＆ Southern Dynasties and has analysed its causes of the formation.
