协调中的差异——以《消除对妇女一切形式歧视公约》的眼光审视我国的《妇女权益保障法》

我国妇女权益保障法与《消除对妇女一切歧视公约》绝大多数是协调的,我们国家已经或正在忠实地履行消除对妇女一切歧视的国际义务。但由于社会意识、设定权利的哲学基础、背景的不同以及我国的习惯,我们的妇女法与《消除对妇女一切歧视公约》还有一些差别,主要表现在权利来源、权利内容等方面,针对差异以及产生差异的原因,我们应采取相应的对策:原则性问题不能动摇,非原则性问题应与国际公约靠近,遗漏的应补上,因习惯导致不同的应改变我们的习惯。

China Feme Law is consistent with ＂Convention on the Elimination of All Forms of Discrimination against Women＂ in most aspect. Our nation has been and is performing faithfully the international obligation to eliminate discriminations on women. But some contrast can still be found between our Feme Law and ＂Convention on the Elimination of All Forms of Discrimination against Women＂ because of our special social sense, philosophy base and background of rights and interests and our custom. Some strategy should be made aiming to these contrasts and the sources of them.
