先合同义务并非传统意义上的合同义务,其产生于缔约双方产生合理信赖之时,终止于合同生效。先合同义务具有一定的特殊性,与相关的合同义务既有联系又有区别。文章将先合同义务与法定义务、附随义务等概念进行比较分析,较为全面地揭示了先合同义务概念的内涵与外延。

The prior-contract obligation is not the traditional obligation of contract. It comes into effect from reasonable reliance between the contractual parties and ends at the execution of the contract. The prior-contract obligation has its own characteristics, both related and different from other duties of contract. This paper analyses the definitions of the prior-contract obligation, the legal obligation and the contingent obligation etc., which point out the denotation and connotation of the prior-contract obligation.
