Our Country's Intellectual Property System Arrangements and Countermeasures in the View of Economical Theory

随着技术因素在经济增长中作用的凸现,知识产权保护问题正逐渐成为各国经济和法律界关注的焦点。文章以经济分析法学为指导,将经济学的模型引入了知识产权保护问题的研究之中,开创性地用经济激励模型和委托-代理模型等微观经济学的理论来深入探析我国在当前的形势下应该选择怎样的知识产权保护制度安排及对策。

As the technology factor has become more and more important in the economic development, the issue of intellectual property protection is being paid more attention to by all the countries in the world. This paper, directed by economic analysis law method, introduces economic models into the research of the problem. Furthermore, it uses the economic incentive model and the principal-agent model for the first time to analyse our country＇s intellectual property system arrangements and countermeasures.
