Which Way We Should Take in Legislating China's Travel Law

旅游法千呼万唤仍不能出台的根本原因,在于对旅游法的许多根本问题缺乏正确的认识,当然更说不上深入研究。本文从旅游法应当规范的基本法律关系入手,分析了旅游法制定的必要性、迫切性以及它应当规范的对象。介绍了世界旅游立法的现状,提出了我国制定旅游法应该选择模式的建议。

The basic reason why China＇s Travel Law still fails to come into being is that we are not correctly aware of many fundamental problems, let alone an in-depth research. This paper, starting from the basic legal relationship that should be standarized in Travel Law, makes an analysis of the necessity, urgent need and the object that should be standarized. It introduces present state of tourism legislation in the world and offers suggestions concerning the mode we should choose in formulationg China＇s Travel Law.
