摘要
从公法性质的国家赔偿的局限性出发,以国家赔偿的价值取向的变迁与国家职能的变迁为依据,展望国家赔偿未来的发展趋势,即国家赔偿应向私法化的方向发展,阐述了国家赔偿私法化应有的内容及特征,并提出了完善我国国家赔偿制度的几点建议。
Beginning with limitation of public law＇s national compensation, according to the alteration of national compensation＇s value orientation and the changing of national function, and looking the future of national compensation＇s tendency, namely in the direction of private law, I expound the deserved content and distinction of national compensation＇s private law, and raise some suggestion about the China＇s national compensation system.
