构建农民工就业权益保障机制——基于“民工荒”的思考

ON CONSTRUCTION OF AN EMPLOYMENT RIGHTS SECURITY MECHANISM FOR PEASANT WORKERS——REFLECTION OVER "PEASANT WORKER SHORTAGE"

就业权益是劳动者最基本的权益。对于农民工来说,实现这一权益的方式主要是通过参加生产而获得劳动报酬。然而,就是这一基本权益也容易遭到侵害。本文从近年来沿海地区发生的“民工荒”现象分析中得到启发,提出构建以最大限度减轻对农民工就业权益的侵害、保障其“收入安全”为目标的农民工就业权益保障机制的新思考。

The employment rights and interests are the fundamental rights and interests of the laborers. For the peasant workers, the primary way to realize these rights and interests is to gain their remuneration through participating production in projects in cities. However, even these most fundamental rights and interests are liable to be infringed. Inspired by the phenomenon of ＂peasant worker shortage＂ that has recently emerged in the coastal areas of China, the author analyzes this phenomenon and proposes a new thinking for constructing an employment rights security mechanism so as to alleviate, to the maximum extent, the infringement of the employment rights of the migrant workers in China and ensure their income security.
