不动产是否适用善意取得制度,各国法律规定不一,我国理论界对此的观点也不统一。本文从不动产善意取得制度的价值目标、法理基础、构成要件、适用范围等多个角度阐述对该制度的看法,指出不动产亦可适用善意取得制度。

Various countries have different opinions on whether the real estate can be applied the system of obtainment of good faith, so does our country. This article expounds the system from its value goal; legal principle theory, the constitutive requirement, the applicable scope and some other aspects, and points out that it＇s suitable to apply the obtainment of good faith.
