摘要
美国州立大学沿用了原殖民地学院“法人———董事会制度”,作为处理内外部关系的基本治理结构,一方面通过贯彻政教分离原则,解除了与教派的紧密联系,另一方面通过贯彻法治原则,确立了州立大学在州普通法上的自治或者在州宪法上的自治的公法人地位,规定了与州政府的复杂关系,从而奠定了美国州立大学的自治地位及不同边界。
American state universities take the "corporation-boards of directors system" of erstwhile colleges in the colony as their basic governance structure to deal with inside and outside relations. They eliminated the close relationship with church by implementing the separation of state and church; on the other hand, they established the autonomic public corporation status of state universities in the state common law or in the sate constitution by implementing the principle of rule of law, and the complicated relationship between the universities and the state governments were prescribed. Consequently, the autonomy status and different board lines of state universities in the United States came into being.
