政府职能转变的法治化是我国建设法治政府的本质要求与客观需要。我国的行政立法开启了规则导向型的政府职能转变方式,特别是《行政许可法》的出台,为我国政府职能转变的法治化提供了一条切实可行的路径。由此,还必须通过法律制度的构筑,对政府职能进行合理定位和重塑。这是在法治的轨道上切实转变政府职能的有效途径。

Transforming government＇s function ruled by law is the essential demand and inevitable requirement for building government ruled by law. The administration legislation of our country have started the function transformation form of the type of the regular direction, especially, the i^suance of ＂Administrative Licensing [~w of the People＇s Republic of China ＂offered a practical and feasible route for transforming government＇s function ruled by law. On this basis, we must rationally localize and remold the government＇ s function by the construction of legal system. This is an effective way of transforming government＇s function ruled by law.
