刑罚功能转化之思考——由刑罚结构轻刑化谈起

Thought on Penalty Function Transformation——from severe penalty structure to tolerant structure

推动我国当前的刑罚重刑结构向轻刑结构转变已成为刑法学界的普遍认识,而刑罚结构的变化则必然引起刑罚功能的转化,从而将导致刑罚的惩罚功能向恢复性功能转化;刑罚的矫正功能向宽容性功能转化;刑罚的威慑功能向警示功能转化。

It is a prevalent viewpoint that the present severe penalty structure of our country should be changed to a tolerant penalty structure. And the change of penalty structure must result in the change of penalty function, that is to say, the punishment function of penalty＇ will convert to be renewing function; the correction function will transform to be tolerant function; the overawing function will change to be caution function.
