失地农民的维权行为分析——以江苏省铁本事件征地案件为例

Behavior of Peasants in Protection of Their Own Rights nvolved in Land Requisition——A Case Study of Tieben Incident

研究目的:以江苏省铁本事件征地案例为例,分析征地过程中失地农民维权行为的发生机理、基本方式、行为选择和影响因素等。研究方法:在对失地农民进行问卷调查的基础上,建立LOGISTIC模型,计量分析失地农民维权决策行为、维权选择行为的微观影响因素。研究结果:失地农民维权行为的产生是多种外部因素和内部因素共同作用的结果,是征地拆迁过程中各种利益体相互制衡的产物,影响失地农民维权决策的主要因素是:家庭人均收入水平、家庭非农就业率、家庭损失和补偿比、家庭恩格尔系数以及对于农地功能的认识。研究结论:中国拆迁征地制度改革应以提高拆迁征地效率、注重各个实体的利益平衡、维护失地农民利益为目标,将失地农民行为纳入拆迁征地决策体系,建立有效保障失地农民利益的拆迁征地制度体系。

The objective of this research is to carry out a systematic study on reasons, basic mode, behavior choice and influencing factors of the behavior of land loss peasants in protection of their rights in land requisition, taking Tieben incident as a case study. Method of questionnaire and Logistic model were employed to analyze the microcosmic influence on their decision-making. The results show the behavior of land loss peasants is affected by external factors and internal factors, and is the result of trade-off of different stakeholders in the process of land requisition and house demolishment. The main factors influencing land loss peasants decision are： the average household income, the rate of loss and compensation of the family, the standard of living and the understandings of function of farmland. Reform of land requisition and house demolishment system should not only aim at improving the efficiency and paying more attention to balancing the interests of stakeholders, but also taking the behavior of land loss peasants into account so as to build up a system that can protect the interests of land loss peasants.
